Can Our Law Firm Collect Your Unpaid Attorney's Fees?

Dealing with Unpaid Fees from Clients of Attorneys No Longer With the Firm

Fees due a firm from clients of a departing partner or associate are different than cases where the attorney is still with the firm. These cases occur when an attorney departed for a different firm and took clients with him/her.

We generally advise law firm clients to wait 1 year from clean disengagement to let the E & O statute to expire on routine collections. But departing attorney matters may be different. If a litigation matter, check the on-line court docket and review the status of the case to see if the departing attorney still represents the former client. If former clients are not paying your firm but still represented by the same attorney, we are willing to pursue contingent fee collection much earlier than a year. It is unlikely that the departed attorney would encourage your former client (their current client) to pursue a defense because that would challenge their own work.

When your firm first gets the feeling that the billings aren’t going to be paid timely, give an immediate Notice of Right to Non-Binding Arbitration (B&P 6142). Don’t explain what it means. You don’t really want non-binding arbitration. We calendar the 30 days and schedule litigation. We generally recommend swift action because the departing attorney must face their own client and new firm.
