Judgment Enforcement to Turn Court Wins into Real Payments

If you already have a court-issued Judgment for a commercial debt in San Diego and need help collecting, don’t try to do this yourself. Collecting a Judgment is a complicated process.

While attempting to collect a Judgment, you’ll need to investigate the debtor and pursue assets, operations and income stream if they don’t pay voluntarily. We induce debtors to want a release of the judgment on an Acknowledgement of Satisfaction of Judgment (EJ-100). They get a Satisfaction when you get your money.

Don’t go through this process alone. The most likely success when you get a Judgment enforcement to finally collect your money is to work with Greenbaum Law Group.

Enforcing Sister State Judgments in California

Do you have a Judgment entered in a US court outside of California? If you do, you’re in luck: these “sister state Judgments” can be enforced under California’s version of the Uniform Enforcement of Sister State Judgments Act. Courts in California follow the guidelines found in Sections 1710.10-1710.65 of the California Code of Civil Procedure whenever they have to deal with sister state Judgements.

The best way to enforce your out-of-state Judgment is to get help from a collection attorney. The legal pros at Greenbaum Law Group will start by filing an authenticated copy of your Judgment with the California court and serving a notice. Then, we’ll be able to start enforcement efforts after 30 days.

Confirming Arbitration Awards and Enforcing Court-Issued Judgments

Sometimes, Greenbaum Law Groups’ clients ask us to help them enforce Arbitration Awards. Unlike Judgments, an Arbitration Award can’t be enforced as is. Arbitration Award must be turned into a court issued Judgment.

When you hire us for help with Arbitration Awards, we’ll start by filing a Petition to Confirm the Arbitration Award (ADR-106) with the appropriate Court. The Court will enforce your Arbitration Award as a Judgment 30 days after service unless contested. At that point, we’ll work on enforcement.

Manufacturing and Distribution Debt Collection for San Diego Companies

San Diego companies in the manufacturing and Distribution sector can access specialized legal remedies if they have unpaid debts. Working closely with the Greenbaum Law Group debt collection attorneys who have years of experience in this field, we can help manufacturing and distribution debt collection cases go smoothly.

The pros at Greenbaum Law Group will work hard to make sure they’re taking full advantage of the recovery opportunities available to manufacturing and distribution businesses. To do that, they’ll pore over your credit applications, Terms and Conditions, electronic/written purchase orders, and anything else that could support your case.

Collecting Foreign Judgments from International Debtors

Not all Judgments against San Diego debtors originate in this city – or in the United States, for that matter. California is one of many US states that has adopted the Uniform Foreign-Country Money Judgments Recognition Act. What this means is that California courts recognize final, conclusive, and enforceable foreign-country Judgments granting or denying the recovery of a sum of money. Sections 1713-1725 of the California Code of Civil Procedure explains how and when courts recognize foreign-country Judgments.

If you have an uncollected court-issued Judgment from a foreign country and the debtor or their assets are in California, Greenbaum Law Group has you covered. We know exactly how to enforce foreign Judgments and help clients get their money in these situations.

Our Proven Process for Collecting San Diego Debts

There’s one huge difference between Greenbaum Law Group and our competitors. We aren’t a collection agency. When you pick us for collection services in San Diego, we won’t sit around wasting time on phone calls and useless letters. Instead, our team of debt collection attorneys will sue your debtor as soon as we’re legally allowed to do so.

How to Know If Your Collection Case Will Succeed

Collection cases are just like any other legal matter. Even a very strong case can be collected or there’s a chance of winning but not collecting. But while we can’t give you a full guarantee of success, we can assure you Greenbaum Law Group will go above and beyond to get your money back.

If you have a recent debt or your debtor has operating businesses, there’s a strong chance your case will be collectible. On the other hand, cases are less likely to succeed when they:

  • Deal with very old debts
  • Involve corporations that have gone out of business
  • Focus on people who are already being punished or pursued by law enforcement
  • Are against people who have filed (or will be filing) for bankruptcy
  • Involve people with lifestyles indicating a lack of assets in the present or future (alcoholics, chronic gamblers, drug abusers, etc.)

No matter what your situation looks like, you’ll get the best possible outcome when you pick Greenbaum Law Group for the job. Before we take on cases, we make sure there’s a reasonable chance our efforts will deliver the results our clients are looking for.

What Clients Need to Do During the Debt Collection Process

If you haven’t gone through a collections case before now, you might wonder what you’ll need to do during this process. As part of Greenbaum Law Group’s investigative work, team members ask you about information that could help your case. They may also ask you about potential tactics.

We don’t typically do initial meetings with prospective clients, nor do we usually hold face-to-face interviews with them. If you do want to meet in person, we’d be happy to set up a brief appointment on video with you once your case has been accepted and acted upon.

Why Local Experience Matters for San Diego Debt Recovery

Whenever you’re dealing with unpaid debts, you deserve help from people who are highly familiar with the federal/state laws that govern debt collection in San Diego. That’s certainly the case for the team members at Greenbaum Law Group – since we focus on commercial collections, the people at our law firm know these laws and the courts.

Unlike other San Diego collection services, Greenbaum Law Group won’t forward your collection claim to another California attorney. Instead, handle the collections we claim ourselves in California. That means you’ll have access to a San Diego collection lawyer you can count on throughout your collections case.

Frequently Asked Questions

How Much Does a Collection Attorney Cost in California?

Greenbaum Law Group charges contingent fees for its services. If we don’t recover money, property, or benefit for clients, we don’t receive a fee. While we put in our time and experience, there are court fees to file and costs for things like service of process that clients will incur. You won’t have to spend money for legal fees to the lawyers in pursuit of debts you’ve already lost.

What Kind of Lawyer Do I Need for Collections?

When you have unpaid debts in San Diego, you need a lawyer who knows all about debt collection in California. If you choose Greenbaum Law Group, that’s exactly what you’ll get – we only pursue commercial debt collection services in this state.

Our collection attorneys focus specifically on enforcing unpaid obligations, filing lawsuits, and pursuing judgment remedies rather than general business or litigation work.

Is It Worth Getting a Lawyer for Debt Collection?

This may come as a surprise, but a collection agency won’t give you the speedy debt collection you’re looking for. If you hire one of these agencies, you might have to wait while they spend time on letters and phone calls.

The bad news is that trying to settle debts on your own can cause just as many problems. Successful debt collection requires legal knowledge and experience – skills most San Diego residents don’t have.

With all this in mind, getting professional lawyers like the crew at Greenbaum Law Group are worth the contingent fee. We’ll deliver the best possible results for your situation with maximum efficiency.

How Does a Collection Attorney Work?

Most commercial collection lawsuits in San Diego are filed in the California Superior Court, which is the trial court that handles the majority of business-related disputes and debt cases.

If you want to work with a qualified San Diego collection attorney, your first step should be providing the facts and information about your debt. From there, your attorney will look closely at the details surrounding your case. They’ll also explore legal strategies that could support their debt recovery efforts.

A collection attorney may conduct asset searches such as reviewing public records, business filings, real property ownership, UCC filings, and banking indicators to determine whether the debtor has collectible assets.

When it’s time to enforce a judgment, a collection attorney can use legal tools such as wage garnishments, bank levies, and property liens. These remedies compel payment when a debtor refuses to pay voluntarily.
